Terms and Conditions (T&C)

1. Introduction and Scope

These Terms and Conditions (“T&C”) govern the use of this website, the webstore, the purchase of digital products, and the provision of online services (coaching, CV rewriting, application editing, career consulting). By accessing this website or purchasing any service, you agree to be legally bound by these T&C in full. The operator is 1A3D GmbH, 8172 Niederglatt, Switzerland (Email: contact@roger-bachmann.ch). If you do not agree, you must not use these services.

2. Webstore and Contract Formation

The webstore offers digital templates, guides, and professional services. Product displays do not constitute a legally binding offer. A contract is formed only once payment is successfully completed. 1A3D GmbH reserves the right to refuse any order, especially in cases of suspected fraud or breach of these T&C.

3. Digital Products

Digital products are delivered electronically immediately after payment. The customer is solely responsible for the technical compatibility of their hardware and software to utilize the downloads.

4. Online Services and Extreme AI Liability Disclaimer

Services (CV rewriting, coaching) rely on the accuracy of the information provided by the customer. The operator is not responsible for inaccuracies resulting from client omissions.

Use of Claude AI in the Members Area: We provide AI-assisted tools powered by Anthropic's Claude AI. Before user input is transmitted to the AI API, an automated script attempts to strip away personal identifiers (names, contact info). STRICT LIABILITY WAIVER: This automated anonymization tool is not flawless. 1A3D GmbH strictly disclaims any and all liability for the failure of this script to remove personal data, nor do we accept liability for any data leaks occurring at the API provider level. Users utilize the AI tools entirely at their own risk. Furthermore, 1A3D GmbH is not liable for hallucinations, errors, or inappropriate content generated by the AI.

5. Prices and Payment

All prices are in Swiss Francs (CHF). Payment is due in full before access to digital products or commencement of services. Prices are subject to change without affecting previously concluded contracts.

6. No Refunds and Complete Waiver of Right of Withdrawal

All sales are final. Due to the immediate delivery nature of digital goods and services, no refunds, returns, or cancellations are offered.

For EU Consumers: By completing your purchase, you explicitly consent to the immediate delivery and commencement of the digital content/service. You acknowledge and agree that by doing so, you waive your statutory right of withdrawal under EU consumer protection laws.

No statutory right of withdrawal exists under Swiss law. Replacements are only issued at the operator's discretion for technical faults originating from our servers.

7. Client Data Handling and Local Sovereignty

By submitting documents, you consent to the processing of your personal data for service delivery.

Local Infrastructure: Original sensitive documents (like your full CV) are not processed in public clouds. They are stored and edited locally on the operator's secure hardware (MacBook) in Switzerland. Encrypted backups are maintained via Microsoft OneDrive for business continuity only.

8. Data Protection Compliance

Data is processed in strict compliance with the EU GDPR and the Swiss Federal Act on Data Protection (FADP). We employ high-level technical measures to secure your data.

9. Data Retention

Application materials are retained for a maximum of twenty four (24) months post-service. Accounting records are kept for ten (10) years per Swiss law. Marketing data is retained until consent is withdrawn.

10. User Rights

Under GDPR and FADP, users have the right to access, rectify, request deletion, and port their personal data. Requests must be sent to contact@roger-bachmann.ch.

11. Cookies and Tracking

Essential cookies are required for website operation. Non-essential tracking cookies require your explicit consent before activation.

12. Intellectual Property

All website content, digital products, and CV templates are protected by copyright. Purchases grant a personal use license only. Resale, modification for commercial use, or redistribution is strictly prohibited.

13. Limitation of Liability

To the absolute maximum extent permitted by Swiss law, 1A3D GmbH excludes all liability for direct, indirect, consequential, or financial damages (including loss of business or data). This exclusion explicitly covers any damages arising from the failure of the AI anonymization tool, data handling errors by AI providers, or reliance on AI-generated content. No guarantee is made regarding job placements, interview success, or specific career outcomes. Services are provided "as is".

14. Force Majeure

We are not liable for delays or failures caused by events outside our control (natural disasters, server outages, government actions).

15. Termination

We reserve the right to suspend accounts or terminate service provision without refund in the event of abusive behavior or a breach of these T&C.

16. Amendments

We may modify these T&C at any time. The version published on the website at the time of your use governs the relationship.

17. Severability

If any clause of these T&C is deemed invalid, the remaining clauses shall remain in full force and effect.

18. Governing Law and Jurisdiction

These T&C are governed exclusively by Swiss law. The exclusive place of jurisdiction is Zurich, Switzerland.
